I am not an American citizen. I live in Australia but I heard about this interview. I am not convinced this is an issue of American nature, the church and the state will never separate, law or no law.

I think that Prop 8 should be challenged as a separation of Church and State issue as well as a 14th amendment issue. By using the word "marriage" to describe civil unions, the State is using a word that has both secular and religious meanings.This looks clearly unconstitutional.The only remedy would be to rename the secular "Marriages" "Civil Unions "and ,of course,all civil unions would be entitled to the same "Equal Protection" of the Constitution. Does this argument have merit?
